1. SPONSOR: The Sponsor for this Sweepstakes Promotion is Hornblower Cruises and Events Holdings, LLC (“Sponsor”), 455 N. Cityfront Plaza Dr., Ste. 2600, Chicago, IL 60611.
2. ELIGIBILITY: The Sweepstakes Promotion and each Sweepstakes is open only to legal U.S. residents of the 50 U.S. and D.C. who are 18 years of age (19 in AL and NE, 21 in MS) or older and in attendance of the Wedding Showcase at which a Sweepstakes is advertised or offered at the time of entry (each, an “Entrant”). Please note: a prize winner must be able to travel to City Cruises Newport Beach as listed as the prize in the Sweepstakes Details, and at a specific location and time, to receive and redeem a prize for a Sweepstakes, or they will forfeit the prize. For prize details for the Sweepstakes, please see the Sweepstakes Details available at the corresponding Activation Site.
3. Automated entries, entries which use or in any way incorporate artificial intelligence or any other simulation of human intelligence or process through the use of a machine or computer system (collectively, “Artificial Intelligence”), either in the creation or submission of the entry or as a part of any entry, and/or third-party entries are prohibited. Any entry that was created by using, or in any way incorporates, Artificial Intelligence, or that was created or made by a third party, will be void, and the entrant who submitted such an entry may be disqualified at Sponsor’s sole discretion. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that entrant’s entries, and that entrant may be disqualified at Sponsor’s discretion. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified. Sponsor and its agencies are not responsible for lost, late, incomplete, damaged, stolen, misdirected or illegible entries; lost, interrupted or unavailable network, server or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the entrant or participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working or inactive email address will be disqualified and ineligible to win.

4. SELECTION OF WINNER: Within seven (7) business days of the end of the Sweepstakes Period, Sponsor will select the name of the potential winner of the prize in a random drawing from among all eligible entries received. The odds of winning are based on the number of eligible entries received during the corresponding Sweepstakes Period. The potential winner will be notified by email at the email address provided at the time of entry.

If a potential winner cannot be contacted after the first attempt to contact them, or if they fail to sign and return any documentation that Sponsor may require within the required time period (if applicable), if potential winner and any companion are unable or unavailable to travel to City Cruises Newport Beach as the prize for the applicable Sweepstakes, or in the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. If Sponsor is unable to determine and verify a potential winner after repeated alternate drawings or if they fail to receive a sufficient number of entries to correspond to the number of prize(s) available to be awarded, Sponsor reserves the right to not award any or all of the prize(s).

Verification of Potential Winner: THE POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

5. PRIZE: One (1) prize winner will receive ten (10) tickets for a Premier Brunch Cruise Bachelor/Bachelorette party as listed as the Prize for the applicable Sweepstakes, and as described in the Sweepstakes Details. Please see the Sweepstakes Details for the approximate retail value (“ARV”) of the Prize. Limit one (1) prize per person per calendar year from all prize promotions offered by Sponsor.

PRIZE RESTRICTIONS: Any and all applicable federal, state and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein or in the Sweepstakes Details, including travel to and from the location where the applicable City Cruises Newport Beach takes place (“Prize City”) as stated in the Sweepstakes Details, any applicable parking and transportation fees, meals, incidentals, novelties, and all other expenses are the responsibility solely of winner. Prize cannot be substituted, assigned, transferred or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at their discretion. Sponsor will not replace any lost or stolen prize. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in the Sweepstakes Details is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in the Sweepstakes Details, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Sponsor is not responsible for any delay or cancellation of the prize delivery or any prize-related sporting event due to unforeseen circumstances or those outside of their control. If the fulfilling merchant cancels the order for reasons out of Sponsor’s control, the prize will not be delivered and no additional compensation will be provided.

Each winner’s guest(s) must be of legal age of majority in their jurisdiction(s) of residence unless accompanied by a parent or legal guardian.  The terms and conditions of the tickets awarded as part of any prize will govern in the event the applicable cruise is canceled due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each winner and his/her guest(s) agree to comply with all applicable laws and regulations and terms in connection with the prize. Sponsor and City Cruises reserve the right to remove or to deny entry to any winner and/or their guest(s) who engage in a disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the cruise. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any City Cruises cruise. City Cruises cruise tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the cruise ticket.

6. GENERAL CONDITIONS: Sweepstakes participation constitutes Entrant’s full and unconditional agreement to these Official Rules, the Sweepstakes Details, and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes and Sweepstakes Promotion. In the event there is a discrepancy or inconsistency between disclosures or other statements (in any and/or all media) contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Proof of sending or submission of entry will not be deemed proof of receipt by Sponsor. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE SWEEPSTAKES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to disqualify any individual it finds to be attempting to tamper with or to undermine the entry process, any website associated with the Sweepstakes, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

9. GESCHILLEN. Wij staan tot uw beschikking om eventuele vragen of opmerkingen die u heeft met betrekking tot de prijsvraag of de prijsvraagcampagne te behandelen. De meeste kwesties kunnen snel op informele wijze worden opgelost. Wij zullen te goeder trouw trachten elk geschil, elke vordering, vraag of meningsverschil rechtstreeks op te lossen door middel van overleg en onderhandelingen te goeder trouw; dit vormt een voorwaarde voordat een van beide partijen een rechtszaak of arbitrageprocedure kan starten.

You agree that any claims that cannot be resolved informally and that relate in any way to or arise out of the Sweepstakes or Sweepstakes Promotion, shall be resolved by binding arbitration. Binding arbitration will be administered on a confidential basis by the American Arbitration Association (the “AAA”) in accordance with the provisions of its Consumer Arbitration Rules, excluding any rules or procedures governing or permitting class actions, and currently available at https://adr.org/sites/default/files/Consumer%20Rules.pdf. The arbitrator, and not any federal, state or local court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability or formation of the Sweepstakes, Sweepstakes Promotion, and/or these Official Rules, including, but not limited to, any claim that all or any part of these Official Rules is void or voidable. The arbitrator shall be empowered to grant whatever relief would be available in a court under law or in equity. The arbitrator’s award shall be binding on the parties and may be entered as a judgment in any court of competent jurisdiction. The interpretation and enforcement of this Agreement to Binding Arbitration shall be subject to the Federal Arbitration Act.

De partijen komen verder overeen dat elke arbitrage alleen in hun individuele hoedanigheid zal worden uitgevoerd en niet als een collectieve rechtszaak of andere representatieve rechtszaak, en de partijen doen uitdrukkelijk afstand van hun recht om een collectieve rechtszaak aan te spannen of schadevergoeding te eisen op basis van een collectieve rechtszaak. Als een rechtbank of arbiter bepaalt dat de afstandsverklaring van collectieve actie zoals uiteengezet in deze paragraaf om welke reden dan ook nietig of onuitvoerbaar is of dat een arbitrage op basis van een collectieve actie kan plaatsvinden, dan wordt de arbitragebepaling zoals hierboven uiteengezet in zijn geheel als nietig beschouwd en worden de partijen geacht niet te zijn overeengekomen om geschillen te arbitreren.

Voor zover de arbitragebepalingen in deze paragraaf niet van toepassing zijn, komen de partijen overeen dat eventuele geschillen tussen hen uitsluitend zullen worden voorgelegd aan staatsrechtbanken of federale rechtbanken in Illinois en stemmen de partijen uitdrukkelijk in met de exclusieve jurisdictie van deze rechtbanken.

10. SEVERABILITEIT: Als een voorwaarde of bepaling van deze Officiële Regels volgens de wet ongeldig of niet-afdwingbaar wordt geacht, dan is deze specifieke voorwaarde of bepaling niet van kracht en wordt deze gescheiden, terwijl de rest van deze Officiële Regels volledig van kracht blijft.

For the name of the winner available after winner has been confirmed, send a self-addressed, stamped envelope with the date you visited the Activation Site for receipt by no later than 6 months after the end of the Promotion Period to: Hornblower Cruises and Events Holdings, LLC, 455 N.
