2. ELIGIBILITY: The Sweepstakes is open only to legal U.S. residents of the 50 U.S. + D.C. who are 18 years of age (19 in AL and NE, 21 in MS) or older at the time of entry (each, an “Entrant”). Please note: the prize winner must be able to travel to and attend the Yankees home game in Bronx, NY on September 10 2025, or will forfeit the prize.. Employees, officers, directors and agents of Sponsor, the MLB Entities, any other company involved in the presentation, administration or fulfillment of the Sweepstakes, and/or their respective subsidiaries, affiliated companies and divisions (collectively, the “Sweepstakes Entities”), and each of their immediate family members (defined as any spouse, partner, parent, legal guardian, sibling, child, legal ward, grandparent, or grandchild, regardless of where they reside) and/or those living in the same household, and those who have previously won a prize from Sponsor within the same calendar year as this Sweepstakes are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winner. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. “MLB Entities” means the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, White Sox, LP. the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated, and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities.

Your Instagram profile must be public to view the post to determine valid entry. Upon completing these steps, you will be automatically entered with one (1) entry into the Sweepstakes. If you do not have an Instagram account, you can create one for free by downloading and creating an account via the Instagram mobile application.Ensure that your Instagram account settings allow the City Cruises Instagram page to contact you via direct messaging in the event that you are selected as a potential winner.

B. Website Entry: To enter online, complete the online entry form at https://www.cityexperiences.com/city-cruises/partnerships/baseball/promo/new-york/ by providing all required information including your full name, state of residence, email address, and submit the online entry form. By completing and submitting the online entry form, you agree to receive marketing emails from Sponsor, and may unsubscribe at any time. You must provide all required information to be eligible to receive an entry.

4. SELECTION OF WINNER On or about September 3, 2025 Sponsor will select the name of potential winner of prize in a random drawing from among all eligible entries received. The odds of winning are based on the number of eligible entries received. The potential winner will be notified on or about September 3, 2025 by direct message via Instagram or email.

If a potential winner cannot be contacted after the first attempt to contact them, or if they fail to sign and return any documentation that Sponsor may require within the required time period (if applicable), if potential winner and any companion are unable or unavailable to travel to and attend Yankees Game in Bronx, NY on September 10 2025, or in the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected by a random drawing from among all remaining eligible entries. If Sponsor is unable to determine and verify a potential winner after repeated alternate drawings or if they fail to receive a sufficient number of entries to correspond to the number of prize(s) available to be awarded, Sponsor reserves the right to not award any or all of the prize(s).

5. PRIZE: One (1) prize winner will receive two (2) tickets for winner and one (1) guest to the Yankees home game in Bronx, NY on September 10 2025. Approximate Retail Value (“ARV”) of the prize: $88.80 USD.

PRIZE RESTRICTIONS: Any and all applicable federal, state and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein, including travel to and from the Yankee Stadium, any applicable parking and transportation fees, meals, incidentals, novelties, and all other expenses are the responsibility solely of winner. Prize cannot be substituted, assigned, transferred or redeemed for cash; however, Sponsor reserves the right to make equivalent prize substitutions at its discretion. Sponsor will not replace any lost or stolen prizes. Prize cannot be used in conjunction with any other promotion or offer. Only the number of prizes stated in these Official Rules is available to be won in the Sweepstakes. If, by reason of a print or other error, more prizes are claimed than the number set forth in these Official Rules, prize winner(s) will be selected in accordance with the winner selection method described above from among all eligible claimants making purportedly valid claims to award the advertised number of prizes available. Sponsor is not responsible for any delay or cancellation of the prize delivery or any prize related sporting event due to unforeseen circumstances or those outside of their control. If the fulfilling merchant cancels the order for reasons out of Sponsor’s control, the prize will not be delivered and no additional compensation will be provided.

Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see yankees.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Winner’s guest(s) must be of legal age of majority in their jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Winner and their guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize; see yankees.com/ballpark for details. Sponsor and the MLB Entities reserve the right to remove or to deny entry to the winner and/or their guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket.

6. 6. AL ENVIAR UNA PARTICIPACIÓN, EL PARTICIPANTE ACEPTA QUE DICHA PARTICIPACIÓN, INCLUIDOS TODOS LOS COMENTARIOS ("PARTICIPACIONES") QUE EL PARTICIPANTE PUEDA ENVIAR AL PATROCINADOR O PUBLICAR EN LAS REDES SOCIALES EN RELACIÓN CON ESTE SORTEO, INCLUIDOS TODOS LOS DERECHOS INCORPORADOS A LA MISMA, CON LA EXCEPCIÓN DE LA INFORMACIÓN DE IDENTIFICACIÓN PERSONAL IDENTIFICADA EN LA POLÍTICA DE PRIVACIDAD DEL PATROCINADOR (DISPONIBLE EN https://www.cityexperiences.com/privacy-policy/), SE CONSIDERAN NO CONFIDENCIALES Y NO SUJETOS A DERECHOS DE PROPIEDAD Y EL PATROCINADOR NO TENDRÁ OBLIGACIÓN DE NINGÚN TIPO CON RESPECTO A DICHOS ENVÍOS. EL PATROCINADOR SERÁ LIBRE DE EDITAR, EXPLOTAR, MODIFICAR, PUBLICAR, REPRODUCIR, UTILIZAR, REVELAR, DIFUNDIR Y DISTRIBUIR LOS ENVÍOS A TERCEROS SIN LIMITACIÓN ALGUNA EN TODOS LOS MEDIOS DE COMUNICACIÓN CONOCIDOS O POR CONOCER, EN TODO EL MUNDO Y A PERPETUIDAD, PARA CUALQUIER FIN, SIN COMPENSACIÓN, PERMISO O NOTIFICACIÓN AL PARTICIPANTE O A TERCEROS. POR LA PRESENTE, EL PARTICIPANTE CONCEDE AL PATROCINADOR Y A SUS REPRESENTANTES LEGALES, SUCESORES Y CESIONARIOS, UNA LICENCIA IRREVOCABLE Y MUNDIAL PARA UTILIZAR A PERPETUIDAD LOS ENVÍOS EN CUALQUIER FORMA O FORMATO Y PARA MODIFICARLOS, Y RECONOCE Y ACEPTA QUE SI EL PATROCINADOR UTILIZA LOS ENVÍOS, EL PARTICIPANTE NO TENDRÁ DERECHO A NINGÚN CRÉDITO, CONSIDERACIÓN, NOTIFICACIÓN O PAGO DE NINGÚN TIPO. EL PARTICIPANTE RENUNCIA A CUALQUIER DERECHO MORAL QUE PUEDA TENER SOBRE LOS ENVÍOS Y ACEPTA QUE SI EL PATROCINADOR DECIDE UTILIZAR LOS ENVÍOS PARA CUALQUIER FIN, TODOS LOS DERECHOS DE AUTOR U OTROS DERECHOS DE PROPIEDAD INTELECTUAL QUE PUEDAN DERIVARSE DE LOS RELACIONADOS CON LOS ENVÍOS DEL PARTICIPANTE O DEL USO DE LOS MISMOS POR PARTE DEL PATROCINADOR SERÁN PROPIEDAD EXCLUSIVA DEL PATROCINADOR. EL CONCURSANTE ACEPTA ADEMÁS QUE, SI EL PATROCINADOR OPTA POR UTILIZAR LOS ENVÍOS DEL CONCURSANTE, EL CONCURSANTE EJECUTARÁ CUALQUIER DOCUMENTO SOLICITADO POR EL PATROCINADOR EN RELACIÓN CON ESTA CESIÓN. SI CUALQUIER USO DE LOS ENVÍOS POR PARTE DEL PATROCINADOR LE HACE RESPONSABLE ANTE TERCEROS, EL PARTICIPANTE ACEPTA INDEMNIZAR AL PATROCINADOR Y A SUS AGENTES, EMPLEADOS, FILIALES, SUBSIDIARIAS, REPRESENTANTES Y TODAS LAS PARTES RELACIONADAS POR TODOS LOS DAÑOS, COSTES, SENTENCIAS Y GASTOS (INCLUIDOS LOS HONORARIOS RAZONABLES DE ABOGADOS) EN LOS QUE INCURRA COMO RESULTADO DEL USO DE LOS ENVÍOS.

SIN LIMITACIÓN DE LO ANTERIOR, TODO LO RELACIONADO CON ESTE SORTEO, INCLUYENDO CADA PLATAFORMA DE MEDIOS SOCIALES Y SITIO WEB ASOCIADO CON ESTE SORTEO Y EL PREMIO, SE PROPORCIONA "TAL CUAL" SIN GARANTÍA DE NINGÚN TIPO, YA SEA EXPRESA O IMPLÍCITA, INCLUYENDO, PERO NO LIMITADO A, LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO PARTICULAR O NO INFRACCIÓN. ALGUNAS JURISDICCIONES PUEDEN NO PERMITIR LAS LIMITACIONES O EXCLUSIONES DE RESPONSABILIDAD POR DAÑOS INCIDENTALES O CONSECUENTES O LA EXCLUSIÓN DE GARANTÍAS IMPLÍCITAS, POR LO QUE ALGUNAS DE LAS LIMITACIONES O EXCLUSIONES ANTERIORES PUEDEN NO SER APLICABLES. CONSULTE LA LEGISLACIÓN LOCAL PARA CONOCER LAS RESTRICCIONES O LIMITACIONES RELATIVAS A ESTAS LIMITACIONES O EXCLUSIONES.

9. DISPUTAS. Estamos a su disposición para resolver cualquier duda que pueda tener en relación con el Sorteo. La mayoría de las preocupaciones pueden resolverse rápidamente por medios informales. Trabajaremos de buena fe para resolver cualquier disputa, reclamación, pregunta o desacuerdo directamente a través de consultas y negociaciones de buena fe, lo cual será una condición previa para que cualquiera de las partes inicie una demanda o arbitraje.

Usted acepta que cualquier reclamación que no pueda resolverse de manera informal y que esté relacionada de algún modo con el Sorteo o surja del mismo, se resolverá mediante arbitraje vinculante. El arbitraje vinculante será administrado de forma confidencial por la Asociación Americana de Arbitraje (la "AAA") de acuerdo con las disposiciones de sus Reglas de Arbitraje del Consumidor, excluyendo cualquier regla o procedimiento que rija o permita las demandas colectivas, y actualmente disponibles en https://adr.org/sites/default/files/Consumer%20Rules.pdf. El árbitro, y no ningún tribunal o agencia federal, estatal o local, tendrá autoridad exclusiva para resolver todas las disputas que surjan o estén relacionadas con la interpretación, aplicabilidad, exigibilidad o formación del Sorteo y/o estas Reglas Oficiales, incluyendo, pero sin limitarse a, cualquier reclamación de que todas o cualquier parte de estas Reglas Oficiales son nulas o anulables. El árbitro estará facultado para conceder cualquier reparación que pudiera corresponder a un tribunal en virtud de la ley o de la equidad. El laudo arbitral será vinculante para las partes y podrá ser presentado como sentencia en cualquier tribunal de jurisdicción competente. La interpretación y aplicación del presente Acuerdo de Arbitraje Vinculante estarán sujetas a la Ley Federal de Arbitraje.

Las partes acuerdan además que cualquier arbitraje se llevará a cabo únicamente a título individual y no como una demanda colectiva u otra acción representativa, y las partes renuncian expresamente a su derecho a presentar una demanda colectiva o a solicitar una reparación sobre una base colectiva. Si cualquier tribunal o árbitro determina que la renuncia a la acción de clase establecida en este párrafo es nula o inaplicable por cualquier motivo o que un arbitraje puede proceder sobre una base de clase, entonces la disposición de arbitraje establecida anteriormente se considerará nula y sin efecto en su totalidad y se considerará que las partes no han acordado arbitrar disputas.

En la medida en que las disposiciones de arbitraje establecidas en esta sección no sean de aplicación, las partes acuerdan que cualquier litigio entre ellas se presentará exclusivamente en los tribunales estatales o federales ubicados en Illinois y las partes consienten expresamente en la jurisdicción exclusiva de los tribunales de los mismos.

10. 10. NULIDAD: Si cualquier término o disposición de estas Reglas Oficiales se considera inválido o inaplicable en virtud de la ley, entonces dicho término o disposición específica carecerá de fuerza y efecto y será eliminado, y el resto de estas Reglas Oficiales continuará en pleno vigor y efecto.
